Will Disputes

Wills can be contested for various reasons such as being invalid because the deceased lacked testamentary capacity or if someone has been left out of the Will or has not been adequately provided for from the Estate.  Eligible persons may bring a family provision claim seeking an order from the Supreme Court that provision be made for them out of the Estate assets, if they were not adequately provided for under the Will.  We have the experience to assist you with either bringing or defending a claim in contested Estate matters.

We can assist you with:

  • Applications for a family provision order where the testator did not make adequate provision for the claimant
  • Challenging Wills on the basis that the testator lacked testamentary capacity
  • Defending claims against the deceased Estate
